The inconsistencies, contradictions and loopholes in the Oregon internet gaming legislation should come as no surprise.. The state has wrestled with gambling laws for centuries, with an equal lack of coherency.
To be brief, let me quote the following, from 350 years ago:
'Note also that playing at Cards, Dice, and the like, are not prohibited by the Common Lawes of this Realm (except that one be deceived by false Dice, or false Cards, and then he that is deceived may have his Action of the case for such deceit); neither are they malum in se, or of their own natures, for then none might be tolerated or licensed to use them; whereas the Statute doth except and tolerate certain persons, places, and times.' - The Country Justice, by Michael Dalton, from a facsimile of the 1655 edition
The Oregon legislation and Mr. Owens notwithstanding, the only novel item here is form, not substance, with the advent of the Internet and instant global communications.
